We get information about you in a range of ways.

"HYMATE” PRIVACY POLICY 

Our Privacy Policy describes the method of dealing with information collected as a result of the conclusion of the license agreement for the use of the "HyMate" application and information processed by the "HyMate" application.


We apply the privacy policy in accordance with the law applicable to the countries in which we operate. In the European Union Member States and in places where the law of a Member State applies under international law, we act in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to processing of personal data and on the free transfer of such data, and repealing Directive 95/46/EC (hereinafter referred to as "the Regulation").

We have defined the rules and methods of collecting and processing information on people using the "HyMate" application in the following relationships between:

I. the Data Administrator and our Customer (also referred to as a Third Party) and,

II. the Processing Entity and Users registered and not registered on the Customer’s platform /website.


Respecting the privacy of our Customers and Application Users, we exercise due diligence and act in accordance with applicable law. In particular, we take care that the data processed by us is:

  • - processed in accordance with the law,

- collected for purposes indicated in this document,

- not subject to further processing incompatible with the above purposes,

- factually correct and adequate in relation to the purposes for which they are processed,

- properly protected against unauthorized access, destruction, disclosure and illegal use,

- kept in a form that allows the identification of persons to whom they relate, no longer than is necessary to achieve the purpose of processing.

This Policy has been divided into two parts. The first one concerns Customers concluding a license agreement related to the use of the Application. The second one was prepared for Application Users - customers of websites and internet platforms where the Application was installed. The last chapter applies to both cases.


By using the "HyMate" Application in any way, you accept this Privacy Policy, the Acceptable Use Policy and the conclusion of the entrustment agreement between the Data Administrator and the Processing Entity with the content published in the "Entrustment agreement" being an attachment to this Policy.e

OTHER USERS OF ‘HYMATE’

PRIVACY POLICY OF THE THIRD PARTY

The User should keep in mind that the Application may include links to other websites that operate independently of the Application and are not supervised by it in any way. Platform/site owners may have their own privacy policies and regulations, which content we recommend reading. When the User provides information through the "HyMate" application on the Third Party platform, the information provided by them may also be independently collected by such site or the owner's platform. The information we collect is covered by this Privacy Policy, and the information that the third party site or platform collects, is subject to the relevant privacy policies and principles applicable to the site or platform. The privacy protection options chosen by the User as part of the Third Party website or platform will not apply to the manner in which we use the information collected by us directly using our Application. It is worth remembering that our Application may contain a link to the privacy policy of the third party's website or platform which is not owned or controlled by us. We therefore are not liable for the privacy practices of such websites/platforms. Therefore, we encourage you to navigate our Application consciously and to read the privacy policies of external websites and platforms that may collect information about the User.

TYPES OF INFORMATION WE PROCESS

The scope of information about the User processed through the "HyMate" application may include:

  • - information shared during registration of the account in the platform/site of a third party using the HyMate application, including, in particular, name, e-mail address, username and password;
  • - information obtained by us from website or platform suppliers about the use of our applications;

location information, including those provided by a mobile device or other device that communicates with our application or associated with the User's IP address, in cases where the law allows us to process such information;

  • - information about actions taken, including the use of our application by the User;
  • - usage data when the User uses our application on websites or at third party platforms, e.g. information about the type of browser or device, unique device identifier and IP address.

HOW WE PROCESS INFORMATION

We process information which the User gives us when they register an account on the website or on a third party platform. We also process information (using different technologies, in particular cookies), when the User uses the "HyMate" application on websites or on third party platforms - regardless of the number of devices used by them and regardless of whether they are logged in or registered. We use analytical and statistical tools to process information, including when the User uses the "HyMate" application on third party sites/platforms.

USE OF INFORMATION 

The processing entity Hycom S.A., which has been entrusted with the processing of personal data of the User, may use this information to the extent and purpose specified in the terms of cooperation with the User Data Administrator, i.e. the owner of the website/platform using the "HyMate" application.


Bearing in mind the applicable legal regulations, we can use the information collected from the User or from devices associated with the User to:

  • W- propose to the User products or services based on the products or services ordered, displayed or purchased by them;

- communicate with the User in matters relating to his account or transactions with us, as well as to send information to the User or ask them for opinions about the functions available on our websites and applications or changes in our policies;

- send the User information about offers and promotions regarding our products and services or products and services of third parties;

- adapt the content and functions to the User's interests;

- display to the User advertisements tailored to his interests based on the actions taken by the User on our websites or applications and on third party websites and applications;

- to operate, understand, optimize, develop and improve our websites, applications, products, services and activities, including using guest surveys and analytical tools;

- detect and investigate activities that may violate our policies or be illegal, as well as prevent such activities.

It is worth remembering that if the User does not consent to the collection of his information, we may not be able to provide the User with specific functions, products and services, and some of our services may not take into account their interests and preferences. If the collection of personal information is mandatory, we will clearly inform the User when collecting this information to enable the User to make an informed decision about using the products or services. Any questions regarding individual personal information about the User that we process or store, and the User's rights regarding personal information may be directed to the Data Protection Officer.

DEFINITIONS

For the purposes of this Policy, we have introduced the following definitions:

Application - the "HyMate" application, a product belonging to Hycom S.A.

Customer/Third party - owner of a platform/website offering its services using the "HyMate" application.

Regulation - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on protection of natural persons with regard to the processing of personal data and on the free transfer of such data and repealing Directive 95/46/EC (general regulation on data protection "RODO").

User - a person browsing or registering an account in a third party platform/site via the "HyMate" application.

ABOUT „HYMATE” APPLICATION

The "HyMate" application is a product belonging to Hycom S.A. with headquarters in Łódź, ul. Piramowicza 11/13, 90-254 Łódź, registered in the Register of Entrepreneurs of the National Court Register by the District Court for the City of ŁÓDŹ ŚRÓDMIEŚCIE IN ŁÓDŹ, 20th Commercial Department under the KRS /National Court Register – translator’s note/ number: 0000561064, NIP /Tax Identification Number – translator’s note/: 7252087369, REGON: 361651723.

It is used to provide the interface for an online store with special emphasis on the service of mobile users.

COOKIE FILES
The "HyMate" application uses cookies or technologies used to collect and save information.

Cookies are commonly used small files containing a string of characters that are sent and saved on the User's end device (i.e. computer, tablet, phone).


Users using the site are kindly requested to voluntarily agree to the processing of cookies by storing information or accessing information already stored in their devices.


The application uses the following cookies:

  • - session files, that is those that exist until the end of a given User session;
  • - persistent files that is, those that exist after the User completes the session.


Cookies contain information necessary for the proper use of the website's functionality, but the User has the option to disable the saving of cookies if they do not agree to the saving of these files. To do this, change the settings of the web browser. After disabling cookies, some of the website's functionalities may not be available.

SHARING INFORMATION WITH OTHER APPLICATION USERS

The information processed by us will not be made available to third parties, except in special circumstances, including:

  • - when the User/Customer allows us to share their personal information;
  • - to IT service providers, in particular those supporting the operation of the Application, who have appropriate security measures;
  • - when permitted by separate law.

SAFETY, INTEGRITY AND STORAGE OF DATA

We attach great importance to ensuring the security, integrity and confidentiality of the personal information of the User and the Third Party. We have implemented technical and organizational security measures that are designed to secure information. We regularly verify our security procedures in terms of the need to apply possible new technologies and methods. We will store the User and Customer’s personal information for the period necessary to achieve the objectives set out in this Privacy Policy and the Customer’s license agreement, unless a longer storage period is required or permitted under applicable law.

GLOBAL TRANSMISSION, STORAGE AND PROCESSING OF DATA

Regardless of the location where we send personal information or where it is stored or processed by us, we will take reasonable steps to protect the privacy of this information and do it in accordance with applicable legal regulations. In addition, in the course of using personal information sent from the European Union or disclosing such information, we use standard contractual clauses approved by the European Commission, we use other measures provided by European Union law, which guarantee an appropriate level of protection of this information, or we ask a person who the data pertains to, to express appropriate consent to such activities.

CHANGES TO THE PRIVACY POLICY

We are constantly improving our Application and strive to adapt the Privacy Policy to the requirements of the principles of good security practices. As a result of the above, we would like to inform you that the content contained in the Privacy Policy may change, in particular in the case of amending the applicable law. The User and the Customer will have permanent access to the current Privacy Policy and will receive from us appropriate notification and/or request for consent, if required by law.

CUSTOMERS CONCLUDING THE LICENSE AGREEMENT FOR THE USE OF "HYMATE"

HYCOM AS THE DATA ADMINISTRATOR

As a result of the implementation of the requirements of the Regulation, we meet the data administrator's obligation to inform our Customers who have decided to conclude a license agreement for the use of the "HyMate" application. We inform you about the principles of personal data processing and about your rights related to it.

By concluding a license agreement related to the purchase of the right to use the "HyMate" application of Hycom S.A. with the headquarters at ul. Piramowicza 11/13, 90-254 Łódź processes your personal data contained in the license agreement for the purpose of this contract. Your personal data will be processed for a period of time specified in applicable law, in particular tax law, as well as for statistical purposes related to the use of the "HyMate" application for up to three months.

In cases where the processing is based on consent, you have the right to withdraw it. For this purpose, please contact us at: iod@hycom.pl. Withdrawal of consent does not affect the legality of the processing carried out before the withdrawal of consent. Your personal data will be processed based on the provisions of law, with particular reference to the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free transfer of such data and repealing Directive 95/46/EC.


We may process your personal data included in the license agreement also for the purpose of determining, investigating or defending against claims, if the claims relate to the concluded license agreement. To this end, we will process your personal data for a period of 3 years from the date of conclusion of the license agreement based on our legitimate interest, consisting in determining, asserting or defending against claims in proceedings before courts or state authorities.

You have the right to access your data, including obtaining copies, rectifying data, requesting its deletion, restricting the processing, object against processing and transfer of data (on processing which you have given consent) to another data administrator. You also have the right to lodge a complaint with the President of the Office for Personal Data Protection.

We may provide your personal data to, among others, statistical tools providers, IT service providers such as hosting and IT systems suppliers.

We do not transfer your personal data outside of the European Economic Area.

TYPES OF INFORMATION WE COLLECT

The scope of information collected about the Customer may include:

  • - data regarding the Customer's business profile, location information in cases where the law allows us to process such information,
  • - data provided during the conclusion of the license agreement necessary for the execution of the agreement,
  • - information from the Customer regarding the way the Application functions.
  • - anonymous data on events and operating parameters of the Application.


HOW WE COLLECT INFORMATION

We collect information which the Customer provides to us when they conclude a license agreement for the use of the "HyMate" application. We also use analytical and statistical tools to collect information, also when they download the "HyMate" application for statistical analysis.

USE OF INFORMATION

Bearing in mind the applicable legal regulations, we can use the information collected from the customer or from devices associated with the Customer based on our legitimate interest in accordance with Article 6 paragraph 1 f) of the Regulation to:

  • - offer products or services to the Customer based on the products or services ordered, displayed or purchased by him;

- communicate with the Customer regarding matters related to the agreement concluded with us, and also to send information to the User or ask him for opinions about the features available in our application;

- send the Customer information about offers and discounts regarding our products and services;

- operate, understand, optimize, develop and improve our websites, applications, products, services and activities, including using surveys and analytical tools;

- detect and investigate activities that may violate our policies or be illegal, as well as prevent such activities.

It is worth remembering that if the customer does not consent to the collection of his information, we may not be able to provide the customer with specific functions, products and services, and some of our services may not take into account his interests and preferences. If the collection of personal information is mandatory, we will clearly inform the customer at the time of collecting this information to enable the Customer to make an informed decision about using the products or services. Any questions regarding individual personal information about the customer that we process or store, and the customer’s rights regarding personal information can be directed to the Data Protection Officer.

CUSTOMER’S PRIVACY POLICY

The Customer concluding the license agreement for the use of the "HyMate" application undertakes to comply with this Privacy Policy, as well as to implement and share their own Privacy Policy with their Users. The Customer is obliged to comply with legal regulations regarding the protection of personal data, with particular reference to the Regulation, if they offer their services in the European Union Member States. In the case of offering services in non-EU countries, the Customer is obliged to comply with legal regulations in the country.
